These Terms and Conditions ("Terms") govern your use of the ClearParcel LLC ("ClearParcel," "we," "us," or "our") website and your purchase of any report, map, or data product (collectively, "Reports") from ClearParcel. By placing an order or using our website, you agree to these Terms.

1. Services

ClearParcel provides GIS-based parcel intelligence reports, topographic and slope buildability maps, and related geospatial data products for properties located within our service area (currently Olmsted, Winona, Wabasha, Fillmore, and Houston counties, Minnesota). Our Reports are informational planning aids and are subject to the limitations described in our Disclaimer.

2. Ordering and Delivery

Orders are placed through our website and paid for at the time of order. Reports are prepared manually and delivered within 48 hours of order confirmation, except where additional time is required due to data availability, complex parcel geometry, or circumstances outside our control. We will notify you if a delay is expected via the email provided at checkout. Turnaround times are estimates and not guaranteed.

Reports are delivered electronically via email to the contact information provided at the time of order. It is your responsibility to provide accurate contact information and to ensure our emails are not blocked by spam filters.

3. Pricing and Payment

Pricing for each Report type is listed on our Coverage & Pricing page and is subject to change without notice. Prices in effect at the time of order apply to that order. Payment is due in full at the time of order through our website's payment processor.

4. Refunds and Cancellations

We want you to be satisfied with your Report. Refunds are granted in the following situations:

  • The order was placed for a parcel outside our service area, or for the wrong county, and a refund is requested before the Report has been produced

  • A data or technical error attributable to ClearParcel resulted in an incorrect Report (e.g., the wrong parcel boundary or PIN was matched, or a calculation error occurred)

  • We are unable to produce a usable Report for the requested parcel due to a lack of available underlying data (e.g., incomplete elevation or parcel data coverage)

  • The order was an accidental duplicate of an existing paid order for the same parcel and Report type placed within 30 days.

  • Cancellation is requested before work on the Report has begun

Refunds are not granted in the following situations:

  • The order was placed with an incorrect PIN, address, or owner name provided by the customer, and the Report was produced correctly based on the information submitted

  • The customer no longer wishes to proceed with a property decision after a Report has been correctly delivered

  • The customer disagrees with the slope buildability classification, flood zone designation, or other data shown in a correctly-produced Report; these are based on publicly available data and the general thresholds described in our Disclaimer, not a guarantee of any particular result

Other situations -- including late delivery beyond our stated turnaround window, or general dissatisfaction with a Report that is otherwise accurate -- will be reviewed at our discretion on a case-by-case basis. We may offer a full refund, partial refund, or a corrected Report depending on the circumstances.

To request a refund, contact us at info@clear-parcel.com within 7 days of delivery, describing the issue. We will review each request individually and respond within 2 business days.

5. Accuracy of Information Provided

You are responsible for providing accurate parcel identification information (such as Property ID Number or property address) when placing an order. ClearParcel is not responsible for delays, errors, or non-refundable charges resulting from inaccurate information provided at the time of order.

6. Intellectual Property

Reports, maps, and their contents remain the intellectual property of ClearParcel LLC. Purchasing a Report grants you a license to use that Report for your own purposes; it does not transfer ownership of the underlying data, design, or methodology to you.

7. Limitation of Liability

To the fullest extent permitted by law, ClearParcel LLC's total liability for any claim arising from your purchase or use of a Report shall not exceed the amount you paid for that Report. ClearParcel is not liable for indirect, incidental, or consequential damages, including decisions made regarding property purchase, development, construction, or land use, as further described in our Disclaimer. ClearParcel does not guarantee any specific development, zoning, permitting, or construction outcome based on the information contained in a Report.

8. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law principles.

ClearParcel LLC ("ClearParcel," "we," "us," or "our") provides GIS-based parcel intelligence reports, topographic and slope buildability maps, and related geospatial data products. By using our website or purchasing a report, you acknowledge and agree to the terms below.

General

The information, maps, and reports provided by ClearParcel are intended as general informational and planning aids only. They are not a substitute for professional legal, surveying, engineering, or zoning advice. ClearParcel makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any data, map, or report we provide. Public datasets may be updated after the date the Report is generated. ClearParcel does not guarantee that any dataset reflects the most current revisions.

Parcel Boundaries

Parcel boundary data is derived from the MnGeo statewide opt-in parcel compilation, a quarterly snapshot dataset assembled from county-submitted data. Boundaries shown in our reports are not suitable for legal determination of property lines and should not be used in place of a licensed land survey. If you need a legally binding boundary determination, contact a licensed Minnesota land surveyor.

Elevation, Topographic, and Slope Buildability Data

Elevation data is derived from MnGeo's Statewide 2nd Generation 0.5m LiDAR Digital Elevation Model. Topographic contours and slope buildability classifications (e.g., "Buildable," "Steep Slope," "Bluff/Conditional," "Unsuitable") are a general planning aid, calculated from publicly available elevation data and a synthesis of common thresholds found across multiple southeast Minnesota county zoning ordinances.

These classifications are not an official zoning determination, bluff determination, or building permit approval, and do not replace a site-specific survey or review by a licensed professional. Specific slope, bluff, and steep-slope thresholds vary by county and jurisdiction, and may differ from the general thresholds used in our reports. Before making any development, construction, or land-use decision, contact your local zoning or planning office to confirm requirements applicable to your specific parcel.

Flood Zone and Other Data Layers

Where included, flood zone, agricultural drainage, broadband coverage, and other data layers are derived from publicly available federal, state, or local sources at the time the report was generated. These layers may not reflect the most current designations or boundary revisions. Contact the relevant issuing agency (e.g., FEMA for flood zone determinations) for official, current information.

Client Duty to Verify

Clients are responsible for verifying all information with the appropriate county, zoning authority, or licensed professional before making decisions.

No Professional Relationship

Use of ClearParcel's website, reports, or data does not create an attorney-client, surveyor-client, engineer-client, or other professional relationship between you and ClearParcel LLC.

Limitation of Liability

To the fullest extent permitted by law, ClearParcel LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, our website, reports, or data, including but not limited to decisions made regarding property purchase, development, construction, or land use.
